1. Services Provided

Good Vibes Productions offers comprehensive event production services in the Winnipeg, Manitoba area.

These include, but are not limited to:

- Wedding and event photography and videography.

- 360-degree video booths and classic photo booths.

- DJ, sound, and lighting services.

- Event hosting, emceeing, and day-of coordination.

Specific details regarding the scope, duration, and deliverables of your chosen Services will be outlined in a separate, personalized Service Agreement or contract signed at the time of booking.

2. Booking, Payments, and Cancellations

- Booking and Retainer: A signed contract and a non-refundable retainer fee are required to secure our Services for your specific event date. Your date is not reserved until both are received.

- Final Payment: The remaining balance for all Services must be paid in full by the date specified in your personalized Service Agreement (typically prior to the event date).

- Cancellations: If you cancel your event, the retainer fee is non-refundable as it covers the administrative time and the opportunity cost of turning away other clients for your date. Additional cancellation fees may apply depending on how close the cancellation is to the event date, as detailed in your specific contract.

- Rescheduling: Requests to reschedule are subject to our availability. If we are unavailable for your new date, the cancellation policy applies.

3. Client Responsibilities

To ensure the highest quality of service, you agree to:

- Provide accurate event details, including schedules, venue addresses, and specific shot lists or requirements well in advance.

- Ensure that Good Vibes Productions has the necessary access and permissions at all event venues to operate equipment, set up lighting, and capture media.

- Designate a point of contact (if not the client) for the day of the event to assist with gathering people for group photos or coordinating logistics.

- Ensure a safe working environment for our staff and equipment.

4. Intellectual Property and Copyright

- Ownership: Good Vibes Productions retains the sole copyright and ownership of all raw and edited photographs, video footage, and audio recordings captured during your event.

- Personal Use License: Upon final payment, clients are granted a non-exclusive, non-transferable license to use, download, print, and share the final delivered media for personal, non-commercial purposes.

- Commercial Use: Clients may not sell, publish for profit, or use the media for commercial advertising without explicit written consent from Good Vibes Productions.

- Editing: Clients are not permitted to re-edit, apply filters, or alter the final delivered photos or videos in a way that misrepresents the artistic integrity of our work.

5. Model Release and Promotional Use

By booking our Services, you grant Good Vibes Productions the irrevocable and unrestricted right to use and publish photographs and videos of you, your guests, and your event for editorial, trade, advertising, portfolio, and any other promotional purpose (including our website and social media). If you require strict privacy and wish to opt out of this model release, it must be negotiated and explicitly stated in your written Service Agreement prior to the event.

6. Delivery of Media

- Timelines: Estimated delivery times for highlight videos, full videos, and photo galleries will be outlined in your contract. We strive to meet these timelines but will not be held liable for reasonable delays due to unforeseen circumstances or high-volume editing seasons.

- Artistic License: Good Vibes Productions reserves the right to exercise artistic discretion in the shooting, selecting, and editing of all media. We do not guarantee that every specific requested shot will be captured or included in the final gallery.

- Raw Footage: Unless explicitly included in your purchased package, raw, unedited photo and video files are not provided to the client.

7. Limitation of Liability

- Equipment Failure and Data Loss: While we take extreme precautions, use professional-grade equipment, and back up our data, Good Vibes Productions is not liable for the loss of media due to catastrophic equipment failure, corrupted memory cards, or acts of God. In the unlikely event of total media loss, our liability is strictly limited to the refund of the fees paid for that specific service.

- Force Majeure: We are not liable for any failure to perform our obligations if such failure is a result of acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disasters), war, terrorist activities, labor dispute, strike, government sanction, blockage, embargo, or catastrophic illness.

- Guest Interference: We are not responsible for ruined shots caused by guests interfering, stepping in front of cameras, or the failure of subjects to cooperate.

8. User Conduct on the Website

When using our website, you agree not to:

- Submit false or misleading information through our contact forms.

- Attempt to gain unauthorized access to our backend systems, servers, or networks.

- Use the website for any unlawful purpose.

9. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein.
